Beachem v. Smith and Little Debbie’s Dream Child Care Learning Centers, Inc.

In Arapahoe County, while crossing an intersection on a traffic light turning from green to yellow, Beachem, plaintiff, was struck by Smith who unlawfully took the right of way, turning in front of, and colliding with, the plaintiff’s vehicle.

The Plaintiff sustained a cervical strain, superimposed upon previous degenerative changes in the cervical spine, with new symptoms and aggravated injuries and degenerative changes brought on because of the motor vehicle collision, including back pain and leg numbness, neck, right shoulder, and right arm pain. Ms. Beachem also sustained economic losses including hospital and physician charge, physical therapy charges, and related medical expenses. In addition, the Plaintiff sustained permanent impairment and disfigurement, and non-economic losses of pain, suffering, and loss of enjoyment of life.
