K.T. (52) was riding his Harley-Davidson northbound on Canterberry Parkway, in Parker, on May 14, 2016 around 12:15 pm. The accident occurred when the Defendant (Robert Smith) took a left heading towards the Black Bear Golf Course, directly cutting in front of K.T. Skid marks indicate that K.T. tried to slow down to avoid impact, but was unsuccessful. The force of the collision threw K.T. and his motorcycle into the air and over Mr. Smith’s car.

Fortunately, K.T. was wearing a helmet at the time of the incident, but he did sustain injuries to his right side. He underwent multiple procedures, including: reconstructive elbow surgery, knee stabilization surgery, and extensor (hand) tendon repair. These operations began five days after the accident.

Six months after the collision, K.T.’s medical expenses were over $200,000

Mr. Smith was the at-fault party in this case. The settlement negotiated by Russell Hatten included the max policy limit payment of $125,000 from an under-insured motorist policy and motorcycle policy, in addition to $250,000 in liability coverage. The total settlement was: $375,000.00.
