In February 2009, Morton Futterman, M.D. was injured in a skiing accident at the Mountain High East ski resort in Wrightwood, California. Dr. Futterman entered an expert area, after the resort had failed to adequately mark, warn or close portions of the trails and slopes.

The signs, fencing and closures led Dr. Futterman to what he believed to be an intermediate ski area, while in fact, the fencing, closures and signs led Dr. Futterman to an “Experts Only” Double Black Diamond Olympic Bowl. While attempting to climb out of the bowl to avoid harm, Dr. Futterman lost footing and tumbled down and sustained a spinal fracture at C6-7, resulting in near-complete quadriplegia.  As a result of his injuries, Dr. Futterman required medical care and treatment, medications, as well as other services.  As a result of his injuries, Dr. Futterman died on September 22, 2010.  A wrongful death claim was filed against the ski resort, in December 2010.

Working with local counsel in Los Angeles, CA, Chalat Hatten Koupal & Banker, represented Dr. Futterman’s family in a wrongful death suit to recover the expense of past medical costs, expenses associated with the funeral and burial, and non economic loss of a father to his children, and husband to his wife. The case was settled prior to trail for a confidential amount.
